Avtivision offers full refund if not happy with inactivity kick

Hi, just to update you on this major problem, I have played 15 games from my last email.
I was in a sniper position (lying down) waiting for my opponents to come into view, I was aiming down sight, I fired a few shots I was not "inactive" and got kicked on each and every occasion.
I take it you would rather I stood up moved around gave away my position and possibly get killed (in game) in the process, in order for me not to get kicked, in this regard you are looking me to implement a "dirty fix" which in fact defeats the purpose of the game. "getting killed" because of this which would contribute to a loss.
This being the case I am now prevented from playing any game to its completion, this was not the case when the game was bought.
"Fundamental" changes to the core programming in the game now prevents me from playing it if I keep getting kicked for a routine that was supposedly implimented to prevent farming of keys its "not fit for purpose".
I will continue to rack up game play videos showing this kick and how I am not "inactive" I would suggest you forward this to your legal department and if they require the video's I can arrange to put them on disk and have them shipped to you.
Please bear in mind I am doing this at considerable time and expense to myself and the longer it goes on the more expensive it is getting.
I do not want your offers of a free sealed unopened copy of BO3 to return to the retailer for a full refund, I do not want Tee shirts or cryptokeys you offered.
Impliment a "proper fix" that is "fit for purpose" or is that beyond your skill?
Would you like me to forward the the video's on to you for examination?

In regards to the legality of the changes implemented, I unfortunately wouldn’t be able to speak to any of it but if you feel the changes are a cause for legal action or concern you can have a lawyer contact our legal department and discuss the legalities. If you are displeased with the game I can have our fulfillment warehouse send a sealed copy of the game to you at no charge. You can then attempt to recuperate your money by returning the game from where you purchased it. I can even provide you with a sealed copy of one our other games, not including Guitar Hero series or Skylanders Series.

Because they're really trying their best in their ability to provide the best customer service to you, and they think you're just persisting with snide threats. They want you to continue playing the game, problem is, you're dealing with a person who thinks that this is a glitch in the game. I dunno about you or anyone else, but it reads like the agent in question didn't even read what you were typing.

The whole point of the "inactivity kick" is to prevent "idle" players. In the previous Call of Duty titles, there were players who'd go outside of the 16 players, 18 players, 24 players maximum lobby limit which resulted in outside cheating. This glitch in question - and I have experienced similar problems as you - I was laying prone, and moving my cursor, my ADS screen left and right to make sure I am not "idle" but trying to chokepoint an area. Yet I was kicked for inactivity. So, I sympathize with you. However, this feature isn't meant for you and me. It's meant for the cheaters. This also stops the campers of the playerbase, too.

Snipers who lay prone aren't campers, let's get that out of the way.
 
I'm in total agreement with you, as far as I'm aware the patch was meant to stop key farming in the gun game, maybe they never foreseen the effect it would have on legit players with different play styles but it has got worse, I have been kicked regular when I forget to move when sniping, its preventing me from playing the games to completion if I don't change my style of playing it will only keep happening.
It should be fixed proper for the purpose it was intended so it doe's not effect legit players.

It seems to me that Activision do not want players with that style of play in the games

We construct the maps so that it’s a tactic that can be used. In some game modes like search and destroy it actually matters, you’re protecting objectives."
Is that a contradiction or was it a way to keep campers buying the game but in truth they are not wanted?
 
What I thought was real strange was they offered to send a sealed copy of the game(so I could return it to a retailer), I could keep the one I had and they offered crypto keys and cod points tee shirts, I think this will all centre around the Legal definition of "inactivity" and being prevented from playing a game to its completion because of it.
That's why I refused the offers it would then have been (case closed) had I accepted a refund.
The game may now be deemed as "not fit for purpose" given what vonn stated

and their definition of "inactivity"
"The reason you’re getting kicked is because your character is not moving (i.e. walking or sprinting), the game recognizes this as you being inactive because of this it kicks you out. If you simply have your character walk a few feet in any direction, every few seconds you can avoid being kicked."
